A Chuka court has sentenced to life imprisonment a 38-year-old man from Kiamucii village in Tharaka Nithi County after pleading guilty to charges of sodomising three primary school boys.
John Kinyua Ndei was charged with sodomizing the three boys aged six, seven and 12 years.
On diverse dates in December last year, the accused proceeded to the home of the 12-year-old boy and upon realizing that the boy was alone, he carried him to his house where he sodomized him while covering his mouth so that he could not raise alarm.
Last month, (May 27), Ndei went back to the home of the boy grabbed him and took him to his house and committed the heinous act and then gave the minor Sh20 and warned him against revealing to anyone.
The boy however informed the parents and his teachers who took him to Chuka County referral Hospital for examination and tests that confirmed that his back had been badly hurt.
On the same day, the accused met the six-year-old on his way to fetch water and requested that they proceed to his room. The boy refused and the man dragged him to his house and committed the ugly act and gave him Sh10.
The court heard that between May 26 and 27 this year, the accused met the seven-year-old boy going to watch TV at a nearby home, grabbed and carried him to his house where he sodomised him repeatedly and also gave him Sh10.
Last week, the two boys were spotted by a teacher fighting over Sh10 and after interrogation confessed that the money had been given to one of them by the suspect.
The accused was later arrested and handed over to Chuka police.
Judgment
He was jailed for life in the cases for the first two boys and 25 years for the third count which he will serve separately.
Senior Resident Magistrate Mwanamkuu Sudi described the accused as a serial defiler and stressed that though he was remorseful, any person found culpable of defiling minors aged below 11 years should be jailed for life and not less than 20 years for those aged above 11 years.
