A secondary school female teacher whose class eight son was reportedly assaulted by his teacher has sued the Teacher Service Commission (TSC) for taking disciplinary action against her after she filed a complaint against her colleague.

Ms Carolyn Mwayuli of St Augustine Mukumu Boys School in Kakamega County wants action taken against her employer for demanding a show-cause letter accusing her of insubordination.

The teacher had filed a complaint with the police against Mr Calystus Magotsi accusing him of causing grievous harm on her son’s abdomen, feet and genitals through canning.

She says, instead of TSC taking action against Mr Magotsi, the commission embarked on taking disciplinary action against her.

Ms Mwayuli through her lawyer, Musyoka and Mogaka advocates, wants the Labour and Employment Court to stop TSC from taking any action against her and to suspend the letter they had required her to submit.

The commission is expected to respond to the accusations on November 29 when the case will be mentioned before a court in Bungoma
