The family of a 22-year-old man who was knocked down by a KDF soldier dying on the spot has breathed a sigh of relief after the court set a hearing date for the case that has been adjourned seven times, five being due to Covid-19.
The soldier, Boniface Muturi, was driving a government vehicle on November 22, 2019 when he knocked down Joshua Kirimi who was riding on a motorbike near Isiolo Referral Hospital along Isiolo-Modogashe road.
Court documents indicate that the soldier was driving carelessly without minding the poor state of the road before the incident occurred.
The accused, who is out on Sh100, 000 bond, in April this year requested the court to adjourn the case saying ‘his lawyer was away’.
The Prosecution side previously lamented that hearing of the matter had taken too long to commence and accused the soldier of delaying the case by seeking adjournments.
The accused’ application for further adjournment dated July 12, 2021 on grounds that his lawyer was outside the country for official duties was allowed but the Isiolo Chief Magistrate Samuel Mungai maintained that the case will not be adjourned again regardless of whether the defense lawyer will be available in court or not.
The court set the hearing date for August 26, 2021.
