A Mombasa-based lawyer has sued the National Emergency Response Committee on Covid-19, Ministry of Health, Attorney-General and Health Cabinet secretary Mutahi Kagwe over the recent announcement that unvaccinated persons will be barred from accessing government and private services from December 21.
Through a petition filed at the High Court in Mombasa, Lawyer Mbarak Hamid says the directive was discriminatory and that the government should carry out adequate public participation to understand the views of the citizens.
He accused the government of failing to conduct enough publicity on vaccination by setting aside only 2.1 percent of the budget for advocacy.
Through lawyer Willis Oluga, Mr Hamid claimed that CS Kagwe had no constitutional mandate to direct state organs or private entities to deny services to unvaccinated people.
The case will be heard on December 15.
The directive issued a week ago bars Kenyans with no proof of vaccination from accessing Kenya Revenue Authority services, National Transport and Safety Authority services, public transport and education services among others.
“Any person seeking inperson government services should be fully vaccinated and proof of vaccination availed,” CS Kagwe recently said.
