The High Court has declared as unconstitutional, Section 22 of the Election Act that requires politicians vying for legislative positions to have a university degree.

In his ruling on Friday, Justice Antony Mrima said Kenyans should be allowed to decide the kind of leaders they want.

County Assemblies Forum (CAF) , the umbrella body for MCAs went to court to challenge implementation of the law in the 2022 General Elections.

Over 100 MPs and over 600 MCA do not have degree and would have been blocked from defending their seats if the law would have been implemented.
